All Four Members of Decapitated Arrested on Alleged Kidnapping Charge

UPDATE, 7:00pm EDT: Decapitated have hired an attorney who claims the band members are innocent, saying the victim visited and left the band “on good terms.”

All four members of Decapitated currently await extradition to Spokane after being arrested in Los Angeles on a charge of kidnapping. The incident allegedly took place after the band’s show in Spokane, WA on August 31st, but the band was not arrested until after last night’s show in Santa Ana, CA.

The Spokesman-Review, which first reported the incident earlier today, has updated their original article to include new information from an attorney hired by the band, Steve Graham, who has gone on record to defend them:

“Defense attorney Steve Graham of Spokane said he was hired by the band on Thursday after they became aware of the investigation.

“There is another side to this,’ he said. ‘We have witnesses that can testify to the fact that the accuser came to visit band of her own free will and left on good terms.’

“He said he told police that the band members had offered to surrender but never heard anything back. ‘I made it clear that I could get the guys up here ASAP and they would cooperate,’ he said.

“Graham said he’s concerned that they will ‘languish’ in the Los Angeles County Jail for weeks before being returned to Spokane, but said the four will not fight extradition and will return to Spokane willingly.”

Without knowing all of the facts, it’s incredibly difficult to pass judgment here. The culture of victim blaming in the world today is absolutely horrendous; the comments we’ve seen on our post earlier today and elsewhere accusing the woman of making this story up for attention, being a groupie, a slut, or worse, are horrible, shameful and embarrassing, to put it mildly. It’s not difficult to imagine what began as a consensual encounter turning into something other than that. On top of that, the attorney’s statement says nothing about what happened between the time the victim arrived and left her visit with the band. Also worth noting: it is literally an attorney’s job to say their clients are innocent.

UPDATE, 6:40pm EDT: KREM is reporting that the band membered were arrested for “first degree kidnapping,” that “the victim said she was held against her will” after attending the August 31st concert at The Pin in Spokane. The alleged crime is being investigated by the Special Victims Unit of the Spokane Police Department. Various other sources are reporting that each member of the band being held on $100,000 bail.

Original Post:

The Spokesman-Review of Spokane, WA is reporting that all four members of Decapitated were arrested early this morning under suspicion of kidnapping a woman after their show in Spokane on August 31st.

Spokane Police Department spokeswoman Cpl. Teresa Fuller told the Spokesman-Review that a woman reported the alleged kidnapping to police early in the morning on September 1st, and that additional charges are possible.

The band members were arrested by the Los Angeles County Sheriff’s Office after last night’s gig in Santa Ana, CA — part of their tour with Thy Art is Murder Fallujah and Ghost Bath — and they are currently in the Los Angeles County Jail awaiting transport back to Spokane. The four men arrested have been identified as 27-year-old Michael M. Lysejko, 35-year-old Waclaw J. Kieltyka, 31-year-old Rafal T. Piotrowski and 30-year-old Hubert E. Wiecek.

MetalSucks has reached out to a representative for Decapitated and those for other bands on the tour, and we will update this post if and when we receive a response. Here’s to hoping this is just a huge misunderstanding, but if the charges are true… oh boy.

No word yet on the status of the rest of Decapitated’s current tour, although it seems certain that at the very least tonight’s gig in Mesa, AZ will be canceled. Watch footage of last night’s show below. Remaining dates:
